Message from the President Welcome to all the new homeowners who have moved in since the Spring.We have had some problems at the pool this year.
A fence post at the pool was struck by lighting so we are working with the fence vendor and our insurance agent to get it repaired. The tear in the pool liner from last year got worse so we had to shut the pool down for repairs.
We are listening to suggestions made from our members. A Mom and Tot day at the pool was instituted on Wednesday mornings from 9am-noon so the little ones could play safely.
The Board would appreciate feed back from anyone who used the Toddler Time. Please let us know if you enjoyed it or not. Also we would like to hear other suggestions you might have.
Please pay particular attention to the Covenant Enforcement Policy in the news letter which will be effective as of September 1st, 2009.

Neighborhood Watch Kids are back to school; families are back from vacation. It’s time to become active in the Neighborhood Watch Program. Contact Billie Francis at 816-873-0069.
SLOW DOWN!!! Just a reminder, the speed limit in Harborview is 25 mph. (All of Smithville, unless posted otherwise, is 25 mph.) Our streets are neighborhood streets, not thoroughfares. Children are back to school and look forward to getting outside when they come home. They often forget to stop and look before running into the street. Parked cars sometimes obstruct the view of a child about to cross the street on his bicycle. Please drive responsibly.
Reminder We have a board seat coming available in January. It is important that we have new faces on the board. You chose this community to live; help make it better.

Covenant Enforcement Policy for Harborview Homeowners Association
Whereas it is clearly the intent of the covenants of HHOA that the Board of Directors of Harborview Homeowners Association (the Board) should create a policy to enforce the covenants of the Harborview Homeowners Association.
Therefore the following policy is established:
Once the Board receives a complaint that a homeowner is not in compliance with the covenants, a member of the board will investigate the complaint. If it is determined that the complaint is viable, a written warning of the violation will be issued to the violator. The violator will be given 7 days to respond in writing to the Board’s letter explaining how they plan to comply with the covenant and when they will be in compliance.
If the Board finds the response acceptable, they will monitor for compliance at the time specified in the response. Non-compliance after the response time or 7 days after the notice if no response will result in a fine of FIVE dollars per DAY being assessed against the homeowner from the date of the written notice of non-compliance until the issue is resolved to the Board’s satisfaction.
After an accumulation of a total fine of $150, the matter will be turned over to our attorney for prosecution. The homeowner will be responsible for ALL fines and additional legal costs. A lien may and will be placed on the property (additional cost of lien $150) and all charges will incur additional penalties at the rate of 8% per annum. After a lien is filed with the Clay County Courthouse the property cannot be sold without a release of lien.
